DrKumo Learn and Earn Referral Program Terms and Conditions

DRKUMO LEARN AND EARN REFERRAL PROGRAM TERMS AND CONDITIONS 

We appreciate your interest in participating in the DrKumo Learn and Earn Referral Program (the “Program”) offered by DrKumo Inc. These Terms and Conditions (the “Terms”) outline the rules and regulations governing your participation in the Program. By participating in the Program, you signify your acceptance of these Terms. If you do not agree with any part of these Terms, please do not participate in the Program. 

  1. 1. General 

These Terms constitute the entire agreement between the Referrer and DrKumo regarding the Referral Program. DrKumo reserves the right to disqualify participants found in violation of these Terms or engaging in fraudulent activities. These Terms are subject to change, and Referrers are encouraged to review them periodically for updates. The terms and conditions set forth in the DrKumo Academy Learn Terms of Use at https://learn.drkumo.com/term-to-use/, as amended from time to time, shall apply to the DrKumo Learn, Refer, Earn Rewards Program and the participants at all times, and nothing herein shall derogate from their applicability. Participation in the DrKumo Learn, Refer, Earn Rewards Program is free of charge and does not require making any purchase or paying any fee to DrKumo Inc.  

  1. 2. Definition of Terms 

  1. a) DrKumo RPM Connected Health Training Program. The DrKumo Connected Health Training Program is a part of the CalGrows initiative. As a training provider of CalGrows, we offer comprehensive courses on Remote Patient Monitoring (RPM). Through this program, direct care workers, caregivers, unpaid care workers, and care coordinators can learn how to effectively utilize RPM technology and deliver exceptional care to patients. 

  1. b) DrKumo Referral Program. DrKumo Referral Program refers to a program established by DrKumo that allows Direct Care Workers and Paid/Unpaid Family Caregivers to recommend and introduce eligible individuals (referred candidates) to the DrKumo RPM Connected Health Training Program Referrers. The Referral Program gives Referrers the opportunity to receive rewards from DrKumo for successful referrals. 

  1. c) DrKumo Trainee. A DrKumo Trainee is an individual who is currently enrolled in the DrKumo RPM Connected Health Training Program and has met DrKumo Eligibility requirements.  

  1. d) DrKumo Referrer. Referrer refers to a DrKumo Trainee who has successfully completed all 7 general training courses from the DrKumo RPM Connected Health Training Program and engages in the DrKumo Referral Program by recommending and introducing potential candidates to the DrKumo RPM Connected Health Training Program. Please check our FAQ for more information about DrKumo Eligibility Requirements. 

  1. e) Referred Candidate. Referred Candidate is an individual who has been recommended and introduced to the DrKumo RPM Connected Health Training Program by a referrer. To be considered a successful referral, the referred candidate must meet DrKumo’s eligibility requirements and successfully complete the 7 general training courses.

  1. 3. Eligibility for Referrers 

To be eligible for the DrKumo Referral Program (“Referral Program”), the DrKumo Referrer (“Referrer”) must meet ALL the following eligibility criteria: 

  1. a) Submitted their Eligibility Form and meet all DrKumo Eligibility Requirements; 

  1. b) Successfully completed all 7 general training courses (15 hours of coursework) to qualify for the gift card incentive; and 

  1. c) Must agree to the terms and conditions of the referral program.

  1. 4. Referral Mechanism 

  1. a) Referrals can be made through personalized referral links or codes provided to eligible participants. 

  1. b) Referrers will receive a unique referral code and link for tracking their referrals. 

  1. c) Referred candidates must be new, eligible caregivers. They should not be currently enrolled in the DrKumo RPM Connected Health Training Program at the time of referral. Additionally, these candidates must meet the DrKumo eligibility criteria and successfully complete all 7 general training courses within the DrKumo RPM Connected Health Training Program.

  1. 5. Rewards 

  1. a) Referrers will receive a $20 Amazon Gift Card for every new, eligible Referred Candidate referred by them who successfully completes the 7 general training courses. 

  1. b) Rewards will be distributed via e-mail after verifying the referred candidate’s successful completion of the training courses. 

  1. c) The maximum number of referrals eligible for rewards is 10 per participant. 

  1. d) No cash alternative to the gift card will be offered. Any redemption or use of the Gift Card, including without limitation, to any and all federal, state, and/or local taxes, shall be the sole responsibility of the Referrer. No substitution of the Gift Card or request for the cash equivalent by the participant will be allowed. 

  1. e) Referrers are responsible for providing accurate contact information for reward distribution.

  1. 6. Code/Link Usage 

  1. a) Referrers are responsible for sharing their referral code and link in compliance with applicable laws and regulations. 

  1. b) Referrers may not engage in spamming or inappropriate referral practices.

  1. 7. Program Modification and Duration 

  1. a) This program commences immediately on January 11, 2024 and will conclude on either: 

  1. April 30, 2024, or 

  1. The date when the Company decides to terminate the program, whichever comes first. 

  1. b) Any changes to the program, including its termination, will be communicated via the DrKumo Academy Site. 

  1. c) DrKumo Inc. reserves the right to change, modify, suspend and/or cancel the Program or any part thereof at any time (including by way of limiting the use of the Gift Cards) at DrKumo’s sole discretion, and without any liability on its part.

  1. 8. Data Protection 

  1. a) Any personal information collected under the Program will be collected, processed and used in accordance with DrKumo’s Privacy Policy, which is available at https://learn.drkumo.com/privacy-policy/. Additionally, this information may be used by DrKumo Inc. for the purposes of administering the Program, and by DrKumo and the Partners for providing the Prizes, including but not limited to name, email address and phone number. 

  1. b) Referrers consent to the use of their name and likeness for promotional purposes related to the Program.

  1. 9. Limitation of Liability; No Warranty 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DRKUMO INC. AND EACH OF ITS AFFILIATES, AS WELL AS THEIR DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS, DISCLAIM ANY LIABILITY FOR DAMAGES OR LOSSES OF ANY KIND ARISING FROM PARTICIPATION IN THE PROGRAM OR ANY OTHER CLAIM RELATED TO THE PROGRAM. THESE DISCLAIMERS COVER, WITHOUT LIMITATION, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE, OR MALFUNCTION, REGARDLESS OF WHETHER DRKUMO INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UNDER WHICH THE CLAIM ARISES. IN JURISDICTIONS WHERE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT ALLOWED, DRKUMO’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW. 

EVERYTHING PROVIDED ON THIS PROGRAM IS OFFERED “AS IS” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PARTICIPANTS ACKNOWLEDGE AND AGREE THAT ANY PRIZES RECEIVED FROM THIS PROGRAM ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, WHETHER EXPRESS OR IMPLIED, IN FACT OR IN LAW. THIS INCLUDES, WITHOUT LIMITATION, WARRANTIES REGARDING QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHERMORE, NO RESPONSIBILITY IS ACCEPTED FOR ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ACTIONS OF ANY GOVERNMENT OR AUTHORITY. 

BY PARTICIPATING IN THE CAMPAIGN, YOU HEREBY RELEASE DRKUMO INC. AND EACH OF ITS AFFILIATES, SUBSIDIARIES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FROM ANY AND ALL LIABILITY, LOSS, CLAIMS, DEMANDS, OR ACTIONS OF ANY KIND WHATSOEVER. THIS RELEASE COVERS INJURIES, DAMAGES, OR LOSSES, TO PERSONS OR PROPERTY, ARISING IN CONNECTION WITH SUBMITTING AN ENTRY, RECEIVING PRIZES, PARTICIPATING IN THE PROGRAM, OR ANY OTHER ASPECT OF THE PROGRAM. 

  1. 10. Governing Law 

The Program and these Terms are subject to the laws of the state of California, excluding the application of conflict of laws principles. By participating in this Program, participants agree that any disputes or causes of action arising out of or connected with the Program that cannot be resolved directly between the parties will be addressed individually. This resolution will take place exclusively before a court located in the state of California. Additionally, in the event of such a dispute, participants expressly waive their rights to pursue claims through class actions. Referrers further acknowledge that, under no circumstances, will they be entitled to seek or obtain awards for punitive, incidental, or consequential damages, including attorneys’ fees. This provision reflects the commitment to individual dispute resolution and the avoidance of class actions in the spirit of fair and efficient legal proceedings.
